<p>Attorney General Michael Atkinson has launched an attack at the Gamers4Croydon party, saying he believes gamers in general are pose a higher personal danger than the outlaw motorcycle gangs he has worked so hard to legislate against.</p>
<p>“I feel my family and I are more at risk from gamers than we are from outlaw motorcycle gangs who also hate me and are running a candidate against me,” Mr Atkinson told ABC TV’s Good Game program last night. <blockquote><p>Atkinson has a trick he performs at each election. Find an enemy that is relatively harmless, but easily vilifiable, target them with quasi legal methodology and play the hapless victim while he denounces the real victim in the press as everything from loony to violent.</p>
<p>I would also speculate that Atkinson&#8217;s idea of spam is probably one or two emails that disagree with his petulant policy making. And threats under the door at 2am? If it&#8217;s not entirely made up, it was probably a note from his milk man.</p></blockquote>

<p><strong>POLICE are wasting $3 million a year policing a bikie club &#8220;made up of grandfathers, union members and gainfully-employed people&#8221;, the Finks have claimed.</strong></p>
<p>In a letter to Attorney-General Michael Atkinson, the outlaw group says it is &#8220;not in the public interest&#8221; to spend time and money banning their organisation &#8220;whilst other areas of (the police) are seeking additional men and equipment&#8221;.</p>
<p>It says the Rann Government&#8217;s push to impose criminal sanctions on its membership is based on incorrect and misdirected evidence – some of it decades out of date.</p>
<p>The club today released its reply to the government&#8217;s application, under the Serious and Organised Crime (Control) Act (2008), to &#8220;declare&#8221; the Finks and control its members.</p>
<p>The application, made in December, alleges 42 current and six former members of the club have engaged in serious criminal activity including rape, robbery with violence, endangering life and the sale of drugs.</p>
<p>In its reply, obtained by AdelaideNow, the club says it exists to promote &#8220;interest in motorcycles of either British or American make&#8221;.</p>
<p>It says it has 35 members – five of whom are grandfathers – none of whom have ever been declared bankrupt.</p>
<p>&#8220;The information supplied &#8230; from SAPOL is incorrect,&#8221; the letter says.</p>
<p>&#8220;Persons who have been attributed offences of violence were not members of the club at the time of the offence (or) are no longer members, or have not been members for decades.</p>
<p>&#8220;Indeed, some of the persons the police refer to would be either deceased or on the aged pension.&#8221;</p>
<p>It says some of the crimes the Government mentions to &#8220;prove&#8221; the club is a criminal organisation &#8220;took place in the 1960s and 1970s&#8221;.</p>
<p>&#8220;SAPOL should target individuals rather than targeting the entire club,&#8221; it says.</p>
<p>The Finks claim police spend $1.6 million policing &#8220;bikie runs&#8221; and a further $1.5 million on its Crime Gang Task Force.</p>
<p>&#8220;This is whilst other areas of (the police) are seeking additional men and equipment,&#8221; the letter says.</p>
<p>&#8220;Proceedings against an association made up of grandfathers, union members and gainfully-employed people is not in the public interest.</p>
<p>&#8220;It can never be in the public interest to render innocent people guilty of a crime simply by association.&#8221;</p>
<p>It is understood Mr Atkinson received the letter late yesterday.</p>

<blockquote><p>The state government needs to crack down on the real criminals rather than waste time and resources on the bogeymen of outlaw motorcycle clubs &#8211; aka &#8220;bikie gangs.&#8221; As many people have already said, tougher gun laws do not effect the criminal elements of society. Only consistant police action against actual criminals can hope to make a dent in what is an already out of control situation. Without a drastic change in state government policy, Adelaide as we know it is doomed.</p></blockquote>

<p><strong>THE man charged over a shootout in Gouger St is a former Iraqi Army corporal and weapons expert with &#8220;extensive&#8221; ties to organised crime, a court has heard.</strong></p>
<p>A prosecutor today alleged Gulf War veteran Ahmed Al-Khafaji fled interstate after the city shooting in May and tried to disguise himself with new tattoos and false identities in NSW and Victoria.</p>
<p>His defence teams rubbished those claims, saying Al Khafaji was an Iraqi refugee and tiler who voluntarily surrendered himself to police.</p>
<p>Al-Khafaji, 38, of Adelaide, has yet to plead to charges of endangering and threatening life.</p>
<p>The charges relate to an incident at Blair Athol in August, in which a man was shot in a leg, and the shootout in Gouger St in May.</p>

<p>Magistrate Ted Iuliano refused to release Al-Khafaji on bail saying the charges against him were too serious.</p>
<p>He was also able to finally lift a suppression on Al-Khafaji’s image.</p>
<p>That order had remained in place past its expiry date due to a police bungle that last week left the court with no idea how far the police investigation had progressed.</p>
<p>Al-Khafaji was remanded in custody until November.</p>

<p>Attorney-General Michael Atkinson, who will introduce the legislation into Parliament this week, said the new laws would help police fight organised crime &#8220;from the inside&#8221;.</p>
<p>&#8220;These laws will help expose drug trafficking, money laundering, illegal weapons trading and gang violence – including murder,&#8221; he said.</p>
<p>&#8220;The work of undercover police officers is critical to stopping some of the most lucrative and dangerous criminal activity in this state.&#8221;</p>
<p>The Criminal Investigation (Covert Operations) Bill 2008 is aimed at facilitating the wider use of undercover police officers to combat organised crime in South Australia.</p>
<p>It is also the first new law in the second wave of legislative measures aimed primarily at combating motorcycle gang activities.</p>
<p>The first wave included tighter firearms laws, riot and affray laws and measures to ban bikie gangs and stop members from associating.</p>
<p>The new legislation will allow police to create and use false identities – including driver&#8217;s licences and birth certificates – to investigate an offence or gather criminal intelligence.</p>
<p>&#8220;These laws will cover how false identity documents are applied for and on which grounds it can be granted,&#8221; he said.</p>
<p>&#8220;The Bill also dictates punishments for the misuse of false identities.</p>
<p>&#8220;It also provides greater legal certainty for covert operatives and agencies involved in undercover operations and delivers better police accountability than previous arrangements.&#8221;</p>
<p>A significant section of the Bill allows undercover police to give evidence in court without disclosing their true identities and potentially exposing themselves and their families to harm.</p>
<p>Under existing laws, an offender often learns the true identity of the undercover officer during the court process, even though the officer&#8217;s name is suppressed from publication.</p>
<p>&#8220;Protecting our front-line fighters in the war against criminal motorcycle gangs is paramount,&#8221; Mr Atkinson said.</p>
<p>&#8220;These brave and dedicated operatives need protection so that they can carry out dangerous but important investigations in the safest possible way&#8221;.</p>
<p>Under the new laws, false identities also will be recognised by interstate law enforcement agencies and cross-border recognition of witness protection certificates will be possible.</p>
<p>&#8220;Criminal bikie gangs don&#8217;t behave themselves once they&#8217;ve crossed a state border,&#8221; Mr Atkinson said.</p>
<p>&#8220;Sometimes they operate across different states to evade detection or capture. Cross-border recognition of South Australian undercover operations will make life easier for police and harder for criminals.&#8221;</p>
<p>The new legislation replaces and greatly expands the Criminal Law (Undercover Operations) Act 1995.</p>
<p>Those laws primarily covered the approval for such operations and gave police officers legal immunity, but did not specifically authorise the measures now being introduced.</p>

<p>Their usual excuse for the erosion of laws divised to protect us from a tyrannical government.</p>
<p>We&#8217;ve already seen the abuse of similar powers in the United States by the FBI. Often they will plant a mole within an organisation who will then suggest, plan and go on to participate in criminal acts &#8211; usually murder, violent robbery or an act of terrorism such as the manufacture and use of home-made explosive devices.</p>
<p>Take the case of the <a target="_blank" href="http://creativityalliance.com/hale.htm">Reverend Doctor Matt Hale</a>. His ideals and speech were not appreciated by the Global Elitists who are hell-bent in the establishment of a one world order with the <i>chosen</i> few at the top and non-White domination of the populace in a socially dysfunctional society at the bottom. The government was unable to catch Reverend Hale in the process of planning or committing any crimes because he did not plan or commit any crimes. That is not his way.</p>
<p>So the FBI decided to plant a mole within Reverend Hale&#8217;s organisation &#8211; the World Church of the Creator &#8211; who not only recorded almost every conversation they ever had together, but also made numerous attempts to get Reverend Hale to authorize the murders of several different people over a number of years. Each time Reverend Hale refused to allow such actions and the FBI treated it as a setback. Finally the mole following orders from the FBI suggested the murder of a federal judge. Once again Reverend Hale refused to authorise a murder, however, the FBI ignored this fact and he was soon arrested and imprisoned on charges of domestic terrorism. Eventually Reverend Hale was convicted on the word of the mole, who claimed that while Reverend Hale was verbally against the murder of a federal judge, he was nodding and winking his approval.</p>

<p>Legal immunity from prosecution for police officers or moles and their ability infiltrate and manipulate otherwise harmless, law-abiding groups into planning and possibly carrying out criminal actions on behalf of a tyrannical government is something that everybody should fear. If police entrapment doesn&#8217;t eventuate in you being incarcerated for the term of your natural life, then you &#8211; the innocent &#8211; may still be gunned down or blown up as the result of a police undercover operation.</p>
<p>Don&#8217;t trust the government, and you may live a little longer.</p>

<p><strong>POLICE say they are ready to take imminent action to outlaw criminal bike gangs after tough new State Government legislation came into effect today.</strong></p>
<p>The Serious and Organised Crime Act allows Police Commissioner Mal Hyde to apply to Attorney-General Michael Atkinson to outlaw individual gangs and place severe restrictions on their members.</p>
<p>Assistant Police Commissioner Tony Harrison this afternoon said police had been gathering information for some time and would soon move against the gangs.</p>
<p>&#8220;A lot of preparatory work has been ongoing and I wouldn&#8217;t anticipate it would be too far down the track before we&#8217;d be in a position to make the first of those applications,&#8221; he said.</p>
<p>&#8220;What we have been doing is considering all of the outlaw motorcycle gangs and their respective criminal activity.</p>
<p>&#8220;We&#8217;ve been going through a fairly comprehensive process in relation to consolidating our information.</p>
<p>&#8220;The legislation will allow police to take a very different approach in terms of the policing of outlaw motorcycle gangs.</p>
<p>&#8220;Outlaw motorcycle gangs have been able to operate effectively for some time because of their criminal associations. I would anticipate that over a period of time we will start to see those associations become more difficult to maintain.&#8221;</p>
<p>Attorney-General Michael Atkinson said bikie gangs had been put on notice and were not welcome in South Australia.</p>
<p>&#8220;The message of the Rann Government to the individual gang members is leave the gang or leave the state,&#8221; Mr Atkinson said. &#8220;We will pursue them until they do.&#8221;</p>
<p>Under the Serious and Organised Crime Act, once the Attorney-General outlaws a bikie gang based on evidence provided by the police a magistrate can then make control orders against gang members, restricting their movement, ability to associate and possess weapons.</p>
<p>A penalty of up to five years&#8217; jail will apply for breaking the order.</p>
<p>Police would also have the power to to issue 72-hour public safety orders banning gang members from going to a public place or attending events.</p>
<p>Opposition police spokesman David Ridgway accused the Government of dragging its heels on the issue.</p>
<p>“It is clear that the enforcement of this Act is not a priority of the Rann Government,” Mr Ridgway said.</p>
<p>“In the past three months there have been bikie related shootings, a murder, home invasions, raids on drug labs and a cache of illegal firearms uncovered.</p>
<p>“Parliament gave police the tools to fight the growing bikie menace but the Rann Government have dragged its heels for more than three months.&#8221;</p>
<p>Meanwhile, police made no arrests during a major raid on a Gypsy Jokers compound in Wingfield this morning.</p>
<p>Police failed to uncover any illegal property or weapons in the Francis Road raid, which began at 10am.</p>

It&#8217;s quite likely that the government is using bikers as the bogeymen of society to divert YOUR attention from the reality of the &#8220;multicultural&#8221; crime gangs such as 49 and Middle East Boys. As for the laws themselves, as others have already pointed out, they can and will be used on the average person who has absolutely no relationship with bikers. All of which are against numerous UN freedom of association rules, regulations and treaties.</p></blockquote>

<p>VICTORIA&#8217;S police chief is warning SA&#8217;s tough new anti-bikie gang laws will lead to increased conflict between police and bikies and drive them underground.<br />
Police Commissioner Christine Nixon says the laws will &#8220;merely drive the visible appearance of organised motorcycle gangs (OMCGs) underground, where the criminal activity will continue to function&#8221;.</p>
<p>&#8220;Rather than displacing OMCG organised crime activity from SA, it is likely the new laws will increase police-OMCG conflict,&#8221; she said.</p>
<p>&#8220;Victoria Police does not support proposals intended to deal with OMCG members in a similar manner to that of terrorist groups by prohibiting groups and individual association between declared persons.&#8221;</p>
<p>In her submission to a federal parliamentary crime inquiry, Ms Nixon also says the SA laws would probably breach Victoria&#8217;s charter of human rights.</p>
<p>SA Police has disagreed with the comments, with a spokeswoman for Police Commissioner Mal Hyde saying police believed &#8220;our legislation will be highly effective in disrupting serious criminal behaviour&#8221;.</p>
<p>&#8216;&#8221;SAPOL can&#8217;t understand Chief Commissioner Nixon&#8217;s opinion these criminals will be driven underground, as serious organised criminals already go to great lengths to keep their criminal activities secret,&#8221; she said.</p>
<p>Queensland&#8217;s Crime and Misconduct Commission also has questioned the effectiveness of the SA laws.</p>
<p>Bikie gang expert Dr Arthur Veno has called for an independent crime commission in SA to oversee the implementation of the new laws.</p>
<p>Their views are contained in submissions to the inquiry into laws to outlaw serious and organised crime groups. The committee is expected to take evidence in Adelaide early next month.</p>
<p>State Parliament passed the new laws last month after an extensive debate and protests from lawyers and civil libertarians.</p>
<p>The tough anti-bikie laws make it an offence for outlaw motorcycle club members or people with criminal records to meet more than six times a year. They also significantly widen police powers to deal with bikie gangs.</p>
<p>A recent bikie funeral in Adelaide for Gypsy Jokers president Wayne &#8220;Chiller&#8221; McGrath, attended by more than 300 people, might have been declared illegal under the new laws, which are yet to come into effect.</p>
<p>The Queensland commission submission says legislation proscribing specific groups may be useful in disrupting the activities of outlaw motorcycle gangs but banning association among certain individuals is likely to be subject to extensive legal challenge.</p>
<p> &#8220;Persons may be sent to jail not for what they do but for who they know,&#8221; it says.</p>
<p>Dr Veno, from Monash University&#8217;s school of political and social inquiry, in a joint submission with Dr Julie van den Eynde, from Queensland University&#8217;s faculty of social and behavioural science, says the new legislation has no checks and balances.</p>
<p>He said the only possible recourse was to put some balance back in the system and to establish an independent commission against corruption to oversee the implementation of the legislation.</p>
<p>A spokeswoman for Attorney-General Michael Atkinson, Jayne Stinson, said the Government made no apology for taking a tough stance and adopting all necessary measures to eradicate criminals from the streets.</p>
<p>&#8220;An ICAC is not necessary,&#8221; she said. &#8220;SA has a comprehensive system of anti-corruption bodies.</p>
<p>&#8220;These include the Police Complaints Authority, the Auditor-General and an Ombudsman with the powers of a royal commission as well as whistleblowers legislation.&#8221;</p>

<p>If you live in SA and have thoughts or beliefs that are contrary to those that the state government allows &#8211; or even worse, contrary to those as allowed by the popular media, you have no legal comeback. If you are rich, you will undoubtedly find some money-grabbing lawyer to reap the profits of your up and coming legal failure, but for the average person, it begins with a series of phonecalls to half a dozen lawyers, whereupon you find that they refuse to even discuss the matter with you. Others will accept you but start with a bill of $300 for a half an hour &#8220;consultation.&#8221; I presume the exhorbitant bill for a 30 minute chat is supposed to disuade you from even thinking of hiring that particular whore of a legal consultant/solicitor.</p>
<p>The Police Complaints Authority plays judge and jury in its own right refusing to investigate cases where, again, it doesn&#8217;t like the particular complainant&#8217;s thoughts or beliefs. When I have seen the PCA investigate a complaint, the person in question has been thoroughly  harrassed by the police to the point where the person making the complaint has barely escaped going to prison for the crime of just trying to enter his own home while the police were visiting a neighbour. In this case, the police were caught lying in court and the case was thrown out. After the complaint was made to the PCA about the violent behaviour of the police, SA Police decided to appeal the case in a higher court. All the previous evidence was ignored, the police by this time had made up a better story and the defendent was abused by the judge &#8211; like I said, barely escaping prison time.</p>
<p>The Ombudsman for ANYTHING in this country is always a joke. They are there to prevent the average person accomplishing anything via a complaint while logging it for statistical purposes as yet another complaint successfully dealt with. All the ombusdman ever does &#8211; whether it&#8217;s the banking, communications or law ombudsman does is advise the complainant that the industry or government agency he or she is making the complaint against has the right to screw him or her over under current law.</p>
<p>The only people who have any legal protection in this state/country are the filthy rich who can afford their own legal expenses and the non-Whites, homosexuals and feminists that usually escape needless persecution through their political correctness.</p>
<p>As for SA&#8217;s whistleblowers legislation?</p>
<p>Blow it out your arse!</p>

<p><strong>THE Opposition [Liberal Party] wants new legislation aimed at stopping bikies from associating to cover their activities in the state&#8217;s prisons.</strong></p>
<p>Opposition correctional services spokesman David Wade said revelations in the Sunday Mail last week of gang brawls indicated the Government was not effectively managing gang members inside prison.</p>
<p>&#8220;Labor is keen to lock people up – it needs to give more attention to effectively managing prisoners while they are in prison,&#8221; he said.</p>
<p>&#8220;The situation is unacceptable and it is only going to get worse as the new bikies&#8217; legislation kicks in. Not only does the legislation lead to more prisoners but the Government&#8217;s legislation gives a blanket exemption allowing gang members to associate within prison.&#8221;</p>
<p>Last week the Sunday Mail revealed police and Correctional Services had met following a number of bikie-related clashes inside Yatala Labour Prison.</p>
<p>Further meetings are planned to facilitate the exchange of information on gang members to enable them to be properly managed when in custody.</p>
<p>Mr Wade said the Government should consider amending the legislation to enable prison management to charge prisoners who associated without reasonable excuse or permission.</p>

&#8220;Labor is keen to lock people up.&#8221; Labor is only keen to lock White people up. It allows Abo and Lebo gangs to terrorise the state while turning &#8220;bikies&#8221; into the boogie men of the decade, but then, Liberal is no better &#8211; and perhaps worse.</p>
<p>A vote for either party is a vote against the supposedly United Nations guaranteed freedoms of assosiation, thought, conscience, religion, opinion and expression.</p>
<p>This in itself shows that democracy as the will of the people and its fanciful UN task force is nothing but a farce put in place to ensure the world remains under the control of the Internationalist Elite. They don&#8217;t care about human rights or the advent totalitarian or despotic governments &#8211; providing that said governments are pro multiracial, multicultural, feminist and overall Marxist in their makeup, and are ready to bow down and lick the grotty behind of that shitty little state known as Israel. However, the above stipulations are only for the Europa and her children. When it comes to the non-White nations, their only stipulations are to join the global economy and give Papa Joe Israel&#8217;s arse the occasional lick.</p>
<p>So once again I say that democracy is a farce, and there can be only one way up and out of this miasma of political machinations. White Revolution is the only solution.</p>

<p><strong>GYPSY Jokers from across Australia have gathered in Adelaide for a funeral which would be illegal under new anti-bikie laws introduced by the State Government.</strong></p>
<p>The bikies were farewelling club president Wayne &#8220;Chiller&#8221; McGrath, 42, a father of four and part-owner of four tattoo parlours, who suffered a fatal heart attack last week while exercising on a treadmill at his Virginia home.</p>
<p>His sudden death prompted public tributes from Gypsy Jokers members nationally and overseas, including the US, Germany, South Africa and Norway.</p>
<p>More than 300 people &#8211; including more than 100 Gypsy Jokers from Adelaide, NSW, Victoria, Queensland, Western Australia, Germany, Norway and the US &#8211; this afternoon attended his funeral at Sydney Harrison Funerals, Ridgehaven, before travelling to the Smithfield Memorial Cemetery, Evanston, where his body was buried.</p>
<p>The mourners &#8211; who included wives, girlfriends and children &#8211; then went to the Gypsy Jokers clubrooms at Wingfield for a wake expected to last most of the week.</p>
<p>Legal sources said under the new anti-bikie laws due to take effect late next month, the funeral and wake would have been declared prohibited events as bikies will be prohibited from associating with each other once their gangs have been declared illegal organisations by Attorney-General Michael Atkinson.</p>
<p>The laws &#8211; the first of their kind in Australia apart from the federal anti-terror legislation &#8211; have been attacked by lawyers and civil liberatarians as &#8220;draconian&#8221; and an erosion of individual rights, particularly freedom of association.</p>
<p>Gypsy Jokers Adelaide chapter sergeant-at-arms &#8220;Davo&#8221; today said it was wrong that bikies would no longer be able to gather together at such events as funerals, weddings and birthday parties with their families and friends.</p>
<p>&#8220;They&#8217;re f&#8230;..d,&#8221; he said.</p>
<p>&#8220;How can something like a funeral be illegal? We&#8217;re here to bury our brother and pay our respects to him and his family.&#8221;</p>
<p>Davo, who would not provide his full name, said Mr McGrath was a &#8220;staunch member, a dedicated family man&#8221;.</p>
<p>&#8220;He leaves a big hole and he will be missed,&#8221; he said.</p>
<p>The laws contain provisions that members of outlaw motorcycle clubs can only associate with direct family members such as their parents, brothers and sisters, grandparents and children.</p>
<p><strong>They are not permitted to gather together or have contact with their uncles, aunties or cousins &#8211; or neighbours and other friends or acquaintances.</p>
<p>Anyone who breaches the laws &#8211; whether they are bikies or individuals having contact with bikies at least six times a year &#8211; can be jailed for up to five years.</strong></p>
<p>Control orders restraining the movements of individual bikies can also be issued by magistrates and judges on the application of SA Police.</p>
<p> Criminal intelligence used by police to obtain the control orders must be classified as such by the Police Commissioner and can be withheld from certain parties in court.    &#8220;Criminal intelligence&#8221; is  defined as information that will prejudice a criminal investigation.</p>
<p>All other information  used when applying for a control order and not classified  &#8220;criminal intelligence&#8221; must be presented in accordance with standard court rules.</p>
<p>There are several points at which appeal action can be taken by a person who is the subject of a control order. Courts must be satisfied that the subject is either a member of an outlawed group, an associate of such a group or is conducting other serious criminal activity  before granting a control order.</p>
<p>Once an order is issued, the subject  has 14 days to lodge an objection with the court which will be heard by a judge who  will consider if there are sufficient grounds for the orders.</p>
<p>If  the subject is still unsatisfied, they can go straight to the Supreme Court on a question of law or seek leave to appeal to the Supreme Court on a question of fact.</p>
<p>In addition, at any time the court can vary or revoke an order. Either  the Police Commissioner can apply to the court at any time or the subject of an order must apply for leave to be heard on the revokation or variation.</p>
<p>Section 41 of the Act also states that, other than the provisions outlined above, there is no other right of judicial review in relation to control orders.</p>

<p><strong>THE first stage of the State Government&#8217;s three-pronged legislative attack on outlaw bikie gangs and their associates comes into force today.</strong></p>
<p>Gang members involved in brawls or those threatening witnesses will be charged with new offences under the Public Order Offences Act, which carries penalties of up to 10 years&#8217; jail or fines of up to $10,000.</p>
<p>The new charges available to police are riot, affray and violent disorder.</p>
<p>They have been designed specifically to target offenders who have previously escaped justice because of witness intimidation or situations in which witnesses – such as rival gang members – have refused to give evidence against the accused.</p>
<p>Attorney-General Michael Atkinson said yesterday the new legislation would set the scene for the pending Serious and Organised Crime Act and the Firearms Prohibition Act that would both be introduced soon.</p>
<p>All three legislative measures are aimed at disrupting, dismantling and discouraging the activities of crime gangs in South Australia.</p>
<p>&#8220;The Act equips police with the tools to further pursue members and associates of criminal gangs who engage in group violence – particularly those involved in outlaw motorcycle gangs,&#8221; he said.</p>
<p>&#8220;It&#8217;s been difficult to secure convictions when bikies and their associates have engaged in violent brawls with rival gangs. Victims, including other gang members, have refused to co-operate with police.</p>
<p>&#8220;The only option has been to charge these criminals with minor offences such as disorderly conduct, which carries a maximum penalty of just three months&#8217; jail.&#8221;</p>
<p>Under the new Act, a person is guilty of riot if they are part of a group of 12 or more who use or threaten violence for a common purpose of causing a reasonable person fear. The maximum penalty is seven years&#8217; jail or 10 years for an aggravated offence.</p>
<p>Any person who uses or threatens violence towards another that would cause them fear is guilty of affray. An offender faces up to three years&#8217; jail and five years for an aggravated offence.</p>
<p>A violent disorder charge can be used when three or more people use or threaten violence and cause a person fear. The maximum penalty is a $10,000 fine or two years&#8217; jail.</p>
<p>Both the Serious and Organised Crime Bill and the Firearms Prohibition Bill have passed through both houses of Parliament, but have not yet been assented to by the Governor, Rear Admiral Kevin Scarce.</p>
<p>The Firearms Prohibition Bill passed the Upper House on Thursday night, paving the way for police to shortly issue prohibition orders against bikie gang members.</p>
<p>Those subject to a prohibition order will face a 15-year jail term if they are caught breaching it. Under the Act police will have the power to stop and search any person subject to an order on sight. Their home and vehicle can also be searched.</p>
